Many individuals and foreign workers wish to come to Canada in order to work in their professional field in one of Canada’s provinces and territories. Luckily, Canada has many options through which an individual can legally work in Canada.
One of the most common ways of obtaining a work permit and eventually, permanent residency, is by way of an Arranged Employment Opinion. In most situations, a worker is required to obtain an official job offer from a Canadian employer (except for applicants for holiday visa programs and open work permits). In addition to obtaining a job offer, most job categories will also require a Labor Market Opinion (LMO). The LMO is a labor market verification, by which an employer must demonstrate that the position which was offered to the foreign worker was initially advertised in Canada and that no Canadian citizen or permanent resident was qualified enough for the position, therefore seeking a foreign employee.
There are several exceptions to the LMO rules, for example for the NAFTA work permit, a post-graduate work permit or an intra-company transferee.
Depending upon the foreign worker’s country of citizenship, a Temporary Resident Visa must be obtained in order to enter Canada legally as an employee. The following are some of the steps required in order to obtain the Visa:
Depending on your particular situation, you may be eligible for different types of work permits. One such permit is called Express Entry. Express Entry is an online assessment tool which facilitates the Government’s ability to review and assess applications from the pool of candidates quicker so that a greater number of qualified individuals can be granted entry to Canada as Permanent Residents.
In order to be added to the pool of candidates, you must complete an online Express Entry profile where you will be asked to provide information regarding your particular set of skills, work experience, language abilities, education, as well as other details.
Applicants who satisfy the conditions of one of the available Federal Programs will be added into the pool of candidates. Those who do not yet have a job offer supported by a Labour Market Impact Assessment (LMIA), or a nomination from a province or territory, must instead register with Employment and Social Development Canada’s (ESDC) Job Bank. This will help connect Express Entry candidates with eligible employers in Canada.
Once a person has been added to the pool of express entry, they will be given a point score according to the program’s point-based Comprehensive Ranking System (CRS), and this score will determine the candidate’s ranking within the pool. Candidates with the highest scores will be invited to apply to immigrate to Canada as permanent residents by being sent an Invitation to Apply (ITA).
The program’s ranking system will assess the details of a candidate’s profile and rank them according to several factors such as economic success, education, particular skills, work experience, language abilities, and a variety of other elements that are known to help migrants flourish in Canada.
Please note that a significant amount of additional points will be awarded to a candidate who has obtained an official job offer from a province or territory nomination, or from an employer in Canada.
In order to have the best chance of being chosen from the express entry pool of candidates by immigration Canada, you must make sure that your application is as complete as possible and contains all relevant information regarding your candidacy.
